SECOND ARMOR – SHIPPING POLICY (C2C MARKETPLACE)

This Shipping Policy forms an integral part of the Second Armor Terms of Service and applies to all users of the Second Armor platform (“Second Armor”, “we”, “us”, “our”). By using shipping services offered through the platform, you agree to this Shipping Policy.
Second Armor operates as a peer-to-peer (C2C) marketplace and acts solely as a neutral technical intermediary between users.
1. ROLE OF SECOND ARMOR
Second Armor provides a technology platform that enables users to buy and sell items and, where available, generate shipping labels through integrated third-party providers.
Second Armor:
- Is not the buyer or seller of listed goods
- Is not a carrier, transport provider, freight forwarder, or logistics operator
- Does not take possession of goods
- Does not organize transport on its own behalf
- Does not act as agent, representative, insurer, or shipper for any user
- Does not guarantee delivery, condition, or existence of any shipment
Shipping is arranged directly by users through third-party providers integrated into the platform.
Nothing in this policy creates any partnership, agency, joint venture, employment, or representation relationship between Second Armor and any user, carrier, logistics provider, or third party.
2. SHIPPING PROVIDER (SENDCLOUD)
Shipping labels available on the platform are generated via Sendcloud, a third-party shipping software provider connecting users to external carriers.
Carriers may include national postal operators and private courier companies depending on destination and service selected.
When a shipping label is generated:
- The user who purchases and uses the label is the sender
- The sender enters into a contract directly with the selected carrier
- Sendcloud acts as technical shipping intermediary
- Second Armor only provides access to label generation through its platform
Second Armor is not a party to the transport contract between sender and carrier.
All shipments are subject to:
- Sendcloud terms and conditions
- The selected carrier’s terms and conditions
- Applicable postal, transport, and customs regulations
Carrier and Sendcloud terms govern the transport service itself. This Shipping Policy governs only the use of shipping features within the Second Armor platform and does not constitute a delivery guarantee.
If shipping documentation or labels display Second Armor, Sendcloud, or another party for technical or formatting reasons, this does not change the identity of the sender or create any carrier or agency relationship with Second Armor.
3. SHIPPING LABEL PURCHASE AND USE
Shipping labels obtained through the platform must:
- Be used only for the specific shipment purchased
- Contain accurate parcel information
- Comply with carrier size, weight, and packaging requirements
- Comply with all applicable laws and regulations
The sender is fully responsible for:
- Correct addresses and contact details
- Parcel dimensions and weight
- Packaging adequacy
- Shipment contents
- Customs documentation and declarations
Any surcharges, penalties, or additional carrier fees resulting from incorrect information may be charged to the sender.
Second Armor reserves the right to pass through or charge users for:
- Carrier adjustments
- Address correction fees
- Return or disposal costs
- Customs or handling surcharges
- Additional shipping charges due to incorrect data
4. PROHIBITED OR RESTRICTED ITEMS
Users must not ship items prohibited by:
- Carrier policies
- Sendcloud policies
- EU or international law
- Import/export regulations
- Local shipping restrictions
The sender bears full responsibility for shipment contents.
Second Armor may, at its sole discretion:
- Cancel shipping labels
- Refuse shipping access
- Suspend accounts
- Report unlawful activity
- Block high-risk shipments
No refund will be provided for labels used or purchased for prohibited shipments except where required by mandatory law or where a refund is available under applicable carrier or Sendcloud terms.
5. DELIVERY TIMES AND OPERATIONS
All delivery times displayed are estimates only and not guaranteed.
Second Armor provides no warranty regarding:
- Delivery speed
- Transit time
- Delivery date
- Delivery success
Delays may occur due to:
- Carrier operations
- Customs processing
- Weather or force majeure
- Security checks
- High-volume periods
- Operational disruptions
Shipping delays do not entitle users to compensation, refund, or cancellation from Second Armor unless required by mandatory law.
Second Armor does not promise or ensure delivery. It only provides access to third-party shipping services.
6. RISK, LOSS, AND DAMAGE
6.1 Responsibility Between Users
All transactions occur directly between buyers and sellers.
Risk relating to shipped goods remains between users according to their agreement and applicable law.
Second Armor does not assume responsibility for:
- Loss of parcels
- Theft
- Damage
- Delivery failure
- Incorrect delivery
- Customs seizure
- Returned shipments
- Actions or omissions of carriers
6.2 Limitation of Platform Liability
To the maximum extent permitted by law, Second Armor shall not be liable for any shipping-related loss or damage.
Where liability cannot legally be excluded, it shall be limited to the lower of:
- The shipping label fee paid through the platform
- The amount recoverable from the carrier or Sendcloud
- The maximum limitation permitted under the Terms of Service
This section is subject to the general limitation of liability set out in the Terms of Service.
Second Armor shall never be liable for indirect, incidental, or consequential damages relating to shipping.
7. INSURANCE AND CLAIMS
Carrier liability and compensation are governed exclusively by:
- Carrier terms
- Sendcloud policies
- Any optional insurance purchased
Shipments are not automatically insured beyond standard carrier coverage.
If additional insurance is available, it must be selected at the time of label purchase.
Users must submit loss or damage claims:
- Within carrier or Sendcloud deadlines
- With all required documentation and evidence
- Through the appropriate claims channel
Required evidence may include:
- Photos of packaging and contents
- Shipping label and tracking
- Proof of value
- Description of damage or loss
Where permitted by law, failure to comply with claim requirements or deadlines may result in denial of the claim.
Second Armor does not guarantee:
- Claim acceptance
- Compensation
- Processing times
8. TRACKING AND DELIVERY CONFIRMATION
Tracking information is provided by carriers via Sendcloud where available.
A shipment marked by the carrier as:
- Delivered
- Signed
- Completed
- Available for pickup
shall be considered fulfilled.
Carrier tracking and delivery confirmation constitute valid proof of shipment and delivery for platform purposes and for dispute resolution between users.
Second Armor is not responsible for:
- Theft after delivery
- Delivery to the address provided by the sender
- Failure to collect from pickup point
- Safe-place or neighbor deliveries accepted by carrier
9. CUSTOMS AND CROSS-BORDER SHIPMENTS
For international shipments, the sender is solely responsible for:
- Customs declarations
- Duties and taxes
- Import/export compliance
- Required documentation
Second Armor bears no responsibility for:
- Customs delays
- Seizures
- Returned shipments
- Import charges
Any duties or taxes are payable by the recipient unless otherwise agreed between buyer and seller.
10. FAILED DELIVERY AND RETURNS
If a parcel is:
- Refused
- Unclaimed
- Undeliverable
- Returned by carrier
additional costs may apply, including return shipping, storage, and handling fees.
Second Armor is not responsible for:
- Returned parcels
- Carrier storage fees
- Carrier disposal of parcels
Reshipment requires purchase of a new shipping label.
11. FRAUD, ABUSE, AND HIGH-RISK SHIPMENTS
Second Armor reserves the right, at its sole discretion, to:
- Refuse or cancel shipping labels
- Restrict shipping features
- Hold transactions or accounts
- Require verification
- Suspend or terminate accounts
where fraud, abuse, or risk is suspected, including:
- Suspicious transaction patterns
- High-risk destinations
- Freight forwarders or reshipping services
- Misuse of shipping labels
- Policy violations
Such actions may be taken without prior notice where reasonably necessary to protect the platform.
12. FORCE MAJEURE
Second Armor shall not be liable for delays or failures caused by events beyond reasonable control, including:
- Natural disasters
- War or civil unrest
- Strikes or labor shortages
- Cyber incidents
- Government action
- Carrier disruption
Obligations are suspended for the duration of such events.
13. GOVERNING LAW
This Shipping Policy shall be governed by the laws of Belgium.
If you are an EU consumer, you will benefit from any mandatory provisions of the law of your country of residence that cannot be waived.
Nothing in this policy limits rights that cannot be excluded under applicable law.
14. MODIFICATIONS
Second Armor reserves the right to modify this Shipping Policy at any time.
The version in force at the time a shipping label is generated or used shall apply.
